Terms of Service

Draft — last updated October 2026.

These Terms govern the use of Attendance Tracking (the “Service”) by the company that signs up (the “Customer”, “you”). By creating an account you accept them on behalf of your company and confirm that you are authorized to do so.

1. The Service

Attendance Tracking lets a Customer register its locations (“Businesses”) with a point on the map and a radius, add its employees, assign them to Businesses with or without a schedule, and let them clock in and out from the web or the mobile app. The Service checks, with the server’s time, that the employee is assigned to the Business, is inside its radius and, when there is a schedule, is within a shift. It also provides corrections, reports and exports.

The Service is a record-keeping tool. It does not calculate wages, does not process payroll and does not give legal advice. You are responsible for how you use its records, including compliance with wage-and-hour, labor and privacy laws that apply to your employees.

2. Accounts

  • Each person signs in with their own email, which must be unique across the Service, and a password. Keep credentials confidential; you are responsible for activity under your company’s accounts.
  • The first administrator of the account (the “owner”) can manage users, the subscription and the closing of the account.
  • You must provide accurate information and keep it up to date.

3. Your employees and their data

  • You decide which employees use the Service and what data you enter about them. You act as the controller (or “business”) of that data; we process it on your behalf to provide the Service (see the Privacy Policy).
  • You must inform your employees, and obtain any consent required by law, before they clock in with location. Before their first clock-in, the Service shows each employee a notice explaining that their location is taken only when they clock in or out.
  • You must not use the Service to track employees outside their work or for any purpose other than recording attendance.

4. Free trial, plans and payment

  • New accounts get a free trial for the period shown when signing up. No payment method is required during the trial.
  • After the trial, continued use requires a paid plan (monthly or yearly). Subscriptions are billed in advance through PayPal and renew automatically until canceled. Prices are shown in U.S. dollars and may exclude taxes.
  • If you subscribe during the trial, the first charge happens when the trial ends.
  • If a payment fails or the trial ends without a plan, there is a grace period. If it is not settled, the account is suspended: nobody in your company can sign in or clock in until the plan is paid. Your data is kept.
  • You can cancel at any time from the Subscription page or from PayPal. Cancellation stops future charges; the current period is not refunded unless required by law.
  • We may change prices with at least 30 days’ notice; the new price applies from your next renewal.

5. Acceptable use

You must not: interfere with the Service or its security; try to access another customer’s data; falsify locations or clock-ins (for example with simulated-location apps); reverse engineer the Service; or use it for unlawful purposes. We may suspend accounts that breach these Terms.

6. Your data, export and deletion

  • You keep all rights to the data you enter. You can export it at any time from Settings.
  • The owner can request the deletion of the company account from My account (web or app). The account is closed immediately and, after 30 days, all its data is deleted. During those 30 days the deletion can be undone by contacting us. Export your records before deleting if you need to keep them (labor laws may require you to retain attendance records).

7. Availability and changes

We work to keep the Service available but do not guarantee uninterrupted operation. Clock-ins require an internet connection and a working location service on the device. We may improve or change features; if a change materially reduces the Service, we will notify you in advance.

8. Disclaimer and limitation of liability

The Service is provided “as is”. To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental or consequential damages, lost profits or lost data. Our total liability for any claim is limited to the amounts you paid for the Service in the 12 months before the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts for non-payment or breach of these Terms.

10. Changes to these Terms

We may update these Terms. We will publish the new version with its date and, for material changes, notify the account owner. Continued use after the effective date means acceptance.

11. Governing law

These Terms are governed by the laws of the United States and of the state where the Service provider is established, without regard to conflict-of-law rules.

12. Contact

Questions about these Terms: write to attendance@dconext.com, preferably from the email address associated with your account.
